Information on the Law on the Protection of Personal Data No. 6698
As Beks Çorap ve İç Giyim San. ve Tic. A.Ş., we would like to inform you about the Law on the Protection of Personal Data No. 6698 (KVKK), which regulates the obligations of real and legal persons who process personal data and the procedures and principles they will comply with, in order to protect the fundamental rights and freedoms of the relevant persons, especially the privacy of private life, in the processing of personal data. In Which Cases and For Which Purposes Can Your Personal Data Be Processed
According to the conditions set forth in Article 5 of the Law on the Protection of Personal Data No. 6698, as a rule, personal data cannot be processed without the explicit consent of the relevant person. However, if one of the following conditions exists, it is possible to process personal data without the explicit consent of the relevant person:
It is clearly provided for in the laws.
It is mandatory for the protection of the life or physical integrity of the person who is unable to give his/her consent due to a de facto impossibility or whose consent is not legally valid, or of another person.
Provided that it is directly related to the establishment or performance of a contract, the processing of personal data belonging to the parties to the contract is necessary.
It is mandatory for the data controller to fulfill its legal obligation.
It is made public by the relevant person.
Data processing is mandatory for the establishment, exercise or protection of a right.
Provided that it does not harm the fundamental rights and freedoms of the relevant person, data processing is mandatory for the legitimate interests of the data controller.
Processing of special personal data without the explicit consent of the relevant person is prohibited according to Article 6 of the Law on the Protection of Personal Data. Special personal data: Data related to individuals’ race, ethnic origin, political views, philosophical beliefs, religion, sect or other beliefs, appearance and dress, association, foundation or union membership, health, sexual life, criminal conviction and security measures, as well as biometric and genetic data are special personal data.
However, special personal data other than the health and sexual life mentioned above may also be processed without the explicit consent of the relevant person in the cases stipulated by the laws. Personal data related to health and sexual life may only be processed by persons or authorized institutions and organizations under a confidentiality obligation without the explicit consent of the relevant person for the purposes of protecting public health, conducting preventive medicine, medical diagnosis, treatment and care services, planning and managing health services and their financing
In addition, it is mandatory to take adequate measures determined by the board in the processing of special personal data.

To Whom and for What Purpose Can Your Processed Personal Data Be Transferred?
KVKK No. 6698 titled Transfer of Personal Data. According to Article 8, personal data cannot be transferred without the explicit consent of the person concerned. In cases where personal data can be processed without the explicit consent of the personal data owner, it can also be transferred to third parties without the explicit consent of the person concerned.
